New Regulation on Importation of Battery-Based Electric Motorized Vehicles

On 11th March 2022, the Ministry of Industry issued Regulation No. 7 the Year 2022 concerning Amendment to Regulation Of The Minister Of Industry Number 28 the Year 2020 Regarding Battery Electric Vehicle In Completely Knocked Down And Incompletely Knocked Down Conditions

This regulation amends the provision that the Importation of Battery-Based Electric Motorized Vehicles (KBL) in Completely Knocked Down (CKD) and Battery-Based KBL in Incompletely Knocked Down (IKD) conditions as referred to in Article 3 Regulation of the Minister of Industry Number 28 the Year 2020 regarding Battery-Based Electric Motor Vehicle in Completely Knocked Down and Incompletely Knocked Down Conditions shall be implemented in accordance with the provisions as stipulated in this regulation.

In carrying out the importation of Battery-Based KBL in CKD condition and Battery-Based KBL in IKD condition, the following provisions shall be applicable: (a) regarding four-wheeled or more battery-based KBL in accordance with the provisions as regulated in Regulation of the Minister of Industry Number 23 the Year 2021 regarding Four or More Wheeled Motorized Vehicles Industry and/or its amendments, and (b) regarding two or three-wheeled battery-based KBL in accordance with the provisions as regulated in the Regulation of the Minister of Industry Number 59M-IND/PER/5/2010 regarding Motorized Vehicle Industry and/or its amendments, as long as it does not conflict with the provisions in this regulation.

In addition, this regulation amends the provision that Battery-Based KBL in CKD condition for four or more wheeled Battery-Based KBL shall include Main Components in the form of: (a) body, cab, and/or chassis, (b) Battery, and (c) electric motor drive system. In addition, this regulation also amends the provision that Battery-Based KBL in CKD condition for two or three-wheeled Battery-Based KBL shall include Main Components in the form of: (a) frame and/or body, (b) Battery, and (c) electric motor drive system. In addition to the Main Components, Battery Based KBL in CKD condition for two or three-wheeled Battery-Based KBL may include Supporting Components. The list of descriptions of Main Components and Supporting Components is set out in Attachment II to this regulation.

Furthermore, this regulation amends the provision that Battery-Based KBL in CKD condition manufacturing process for four or more wheeled Battery-Based KBL is carried out to produce Battery-Based KBL in the form of: (a) motorized vehicles for the transportation of ten people, or more including the driver, which is included in sub-heading 8702.40, (b) motorized vehicles for the transportation of people included in sub-heading 8703.80, and (c) motorized vehicles for the carriage of goods, in sub-heading 8704.90.

This regulation comes into effect on 11 March 2022.
